RETURNS POLICY OF THE ONLINE STORE ETHNE.EU
applies to: Products – movable goods (including movable goods with digital elements)
1. A consumer who has concluded a distance contract may, within 14 calendar days, withdraw from it without giving any reason and without incurring costs, except for the costs specified in point 9 below. To meet the deadline it is sufficient to send the statement before its expiry. The statement of withdrawal from the contract may be submitted, for example:
1.1. in writing to the address: ul. Hoża 86/410, 00-682 Warsaw, Poland;
1.2. in electronic form via e-mail to the address: .
2. The return of the Product under withdrawal from the contract should be made to the address: ul. Paderewskiego 44, 05-520 Konstancin-Jeziorna, Poland.
3. A sample withdrawal form is included in Annex 2 to the Consumer Rights Act and is additionally available in pt. 14 of the Terms and Conditions. The consumer may use the sample form, but it is not obligatory.
4. The period for withdrawal from the contract begins:
4.1. for a contract under which the Seller hands over the Product, being obliged to transfer its ownership – from taking possession of the Product by the consumer or a third party indicated by the consumer other than the carrier, and in the case of a contract which: (1) includes multiple Products delivered separately, in batches or in parts – from taking possession of the last Product, batch or part, or (2) consists in regular delivery of Products for a fixed period – from taking possession of the first of the Products;
4.2. for other contracts – from the day of concluding the contract.
5. In the event of withdrawal from a distance contract, the contract is deemed not concluded.
6. The Seller is obliged to refund to the consumer immediately, no later than within 14 calendar days from the day of receiving the consumer’s statement of withdrawal from the contract, all payments made by the consumer, including the costs of delivery of the Product (except for additional costs resulting from the delivery method chosen by the consumer other than the cheapest ordinary delivery method available in the Online Store). The Seller refunds the payment using the same payment method used by the consumer, unless the consumer has expressly agreed to a different refund method that does not entail any costs for him. If the Seller has not offered to collect the Product from the consumer himself, he may withhold the refund until he has received the Product back or the consumer has supplied evidence of having sent back the Product, whichever occurs earlier.
7. The consumer is obliged to return the Product to the Seller or hand it over to a person authorised by the Seller to collect it immediately, no later than within 14 calendar days from the day on which he/she withdrew from the contract, unless the Seller has offered to collect the Product himself. To meet the deadline, it is sufficient to send back the Product before the deadline expires.
8. The consumer is liable for any diminished value of the Product resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Product.
9. Possible costs related to withdrawal by the consumer from the contract, which the consumer is obliged to bear:
9.1. if the consumer has chosen a method of delivery of the Product other than the cheapest ordinary delivery method available in the Online Store, the Seller is not obliged to refund the additional costs incurred by the consumer.
9.2. The consumer bears the direct costs of returning the Product.
10. The right of withdrawal from a distance contract does not apply to the consumer in relation to contracts where the object of the performance is a Product delivered in a sealed package which, once opened, cannot be returned for health protection or hygiene reasons if the package has been opened after delivery.
11. In other matters the provisions of the Terms and Conditions apply.
